SantaAnna Pomeranians Contract

 

I, Sarah Morris herby known as Seller, herein state that to the best of my knowledge and/or Veterinarian that this puppy/dog is to be physically healthy.

Buyer shall have 3 days to have puppy/dog given a wellness check by his/her choice of a licensed Veterinarian.

 

We guarantee our puppies are in good health at the time of sale, free from any life-threatening congenital defects infectious diseases (i.e. heart, kidney, lung failure, Parvo etc.) Everything possible has been done to keep each puppy dog healthy and happy on our premises. This guarantee is valid for three days once in buyers care, but they must have their puppy into a vet within three days of possession to continue the health guarantee until the puppies first birthday. Please send us documentation of your proof of veterinarian exam.

 

***If the vet finds a life-threatening congenital condition present buyer agrees to notify seller the same day as the initial vet visit. Seller is to be notified of any such finding immediately so proper adjustments can be made. At no time, will there be a refund given back to buyer. A written explanation and/or documentation from a veterinarian MUST be shown at the time of exchange. This is to include the Veterinarians name, address and such date of his/her findings. A copy is to be provided to the seller from the buyer at the time of exchange. Failure to do so will delay exchange or result exchange to be voided.

In case of fatal genetic defect within the 3-day health period or with 1 year "proven genetic defect" guarantee, the seller will exchange puppy/dog for another one of equal value or lesser value. (Note; if there is a puppy you desire that cost more than your purchase you may pay the difference if that Puppy is available at that time.) Exchange shall be left up solely to the seller’s discretion. Genetic results from online sellers (for example embark, UC Davis, paw print) will be not accepted as a diagnosis. SantaAnna poms assumes no financial responsibility after the Pomeranian leaves the premises. This includes but is not limited to: medical expenses, landlords' disapproval, allergy to animals, mortality, disagreement of family or spouse, or any other reason except congenital birth defect causing death (in which you will receive a replacement puppy of equal or lesser value).  

 

If puppy/dog is not Vet checked within the specified time this agreement is voided.

A Health Record has been given to the buyer at the time of sale stating all medications, vaccinations and worming has been given to puppy/dog as of this date

If at any point of time buyer decides they can no longer care for said puppy/dog, Breeder must be notified and be given 1st option to have said puppy/dog at no cost. Said puppy/dog MUST NOT be resold, be place in a shelter or humane society at any point or time!

*** The buyer is responsible for all shipping costs and any and all that expenses if the buyer neglects to have the puppy checked by certified veterinarian within three business days of arrival all guarantees are Noll and void. Please make sure to send a copy of your vet check as proof. If your dog has been micro chipped that identification should also be on the veterinarian’s paperwork.

 

We will have the puppy examined by a veterinarian for overall health, a signed health certificate will be provided within 10 days of shipping.

We DO NOT GUARANTEE: the ability to breed, size, coat color or consistency, confirmation, or disposition of the puppy at maturity. (We will provide a guestimate of adult size based on the weigh chart, parents’ weights, and the history of what our dogs produce.) This health guarantee does not cover hypoglycemia, coccidiosis, giardia, allergies, respiratory infections, luxating patella's, internal/external parasites or any other nonlife-threatening conditions (ones that can be prevented OR traits that are not life threatening) once the puppy has left our care. Diseases contracted due to lack of diligence of vaccinations once they have left our care are also not covered.

**Hypoglycemia (sugar shock) prevention is the responsibility of the buyer. We recommend Nutrical or similar product (Karo Syrup) to be kept on-hand (especially with Poms under two pounds at eight weeks) – In cases these products are not on hand, safe-for-dogs peanut butter mixed with honey or Karo Syrup will suffice until Nutrical can be purchased. Please read about Hypoglycemia (a page on our website).

Show dogs: All dogs even if purchased for show, I’ve sold as pet quality we do not guarantee the ability to show in the ring 

Dewclaws: most of the time we remove dewclaws from puppies when they are 3 to 1 week old unless we forget or it’s not safe for the puppy we do not guarantee the removal or that they won’t go back we do not charge for the service nor will we pay for it should you wish for any missed regrow and dewclaws to be removed. 

 

Breeding dogs: buyer agrees that dogs purchase from Seller are only be used in other registered Pomeranians. Please buy from someone else if you wish to breed designer dogs pomskys, pomchis etc.

I would like my hard work shown on your dog’s paperwork please put SantaAnna and your dogs registered name in AKC registration. 

 

DOGS PURCHASED AS PET ONLY, if this animal is purchased as PET only, and is bred, seller has the right to seize puppy/dog sold in this agreement along with any puppy’s the dog/puppy produces including puppies sold to others at buyer expense.  INITALS ______________

 

If you purchase a puppy from us you were agreeing to our policy in terms concerning our puppy contract listed here and guarantees purchase price, includes if available specified puppy of your choice. Once you choose your puppy you are locked into the puppy. Puppy is not held until deposit it received. No switching puppies after money has been received without forfeiting the already paid funds.

 

AKC registration paperwork: pick of the litter breeding contractual puppy, registration paperwork of different registries, health check and health certificate will be signed by seller prior to shipping. Puppies will have up-to-date worm prevention and vaccinations. Eight week old puppies will have two Parvo shots at six and eight weeks and Bordetella (kennel cough) vaccination unless very small, or we decide to delayed shots by the vets recommendation. Puppies will also have any other applicable medical treatments as deemed necessary by the veterinarian. We also try to get prevention care before the puppy leaves our care Giardia, coccidia, and babies are weaned one week before leaving. Puppies are not fully vaccinated against Parvo until they have had a minimum of four shots and then they will require more to keep them fully vaccinated. Your puppy is not coming with four shots so please do not put them on the ground and highly traffic areas. They could pick up Parvo and with small dogs it could likely cost him or her his life it’s best to be safe than sorry.

Any animal bought from this seller will require a nonrefundable deposit for a hold service which is applied towards the total purchase. A $500 deposit will reserve the puppy until it turns 12 weeks in this puppy’s case I will hold until ________

Puppy will not be shipped until entire amount for puppy is paid for. Puppy must be paid by _________. If puppy is not paid in full by date listed, buyer forfeits the right to puppy.

 

**** only if approved by seller in writing and they are very special circumstances we will hold puppies for more than 12 weeks there’s an additional charge of $20 per week be on the first 12 weeks for puppies remaining with us. Buyer must pay for additional warming care cleaning food in space needed. We will sell puppies at 8 to 12 weeks and do not plan to accommodate puppies older than this. If the seller’s recommendation is to hold a puppy the fees for holding puppy longer than 12 weeks will not be charged. The buyers responsible for the $50 certificate and 50$ additional parvo shot if the puppy must be shipped commercially or cross state lines or if the puppy is 16 weeks or older at the time of pick up.

 

We reserve the right to refuse any and all sales we do not have to provide a reason.

 

Failure to follow this contract will entitle the Breeder to the amount of $500 as a result of Breach of Contract and any Legal Fees associated with any Legal Actions.

The Buyer understands this is a LEGALLY Binding Contract.

With Ozark Jet-A-Pet, prices are typically $400 during COVID (This is flying cargo - not recommended in very cold/hot temperatures); Ground shipping can range from $400-$600; or Flight Nanny $550-600.  If you fly with Ozark Jet-A-Pet, you will pay me the additional $400.  If you choose a ground shipper or flight nanny, I will connect you with the USDA-certified shipper, and you will pay them directly. SHIPPED puppies must be paid in full by the Monday of the week prior to shipping.

Please do not send money electronically within a few days of picking up your puppy.  Money needs to be cleared before the puppy leaves, and many times, transactions pend a few days.  Pay for the puppy one week in advance to pick up OR bring cash with you to pay your balance due.
